The panel in the conference presented for the first time in the MENA region the new ICC Dispute Board Rules, in force as of 1 October 2015. The panel provided an introduction to the amendments to the Rules. Dispute board (DB) practitioners also discussed how the DBs work in practice, the costs of DB proceedings and their links to arbitration. Taswiyeh was invited to meet with members of the Secretariat of the ICC International Court of Arbitration and ICC arbitration practitioners for a unique insider view of the ICC’s work and practice.

  2. It is a consulting firm that specializes in financial, commercial and technical conflict management services and is considered to be one of the first private financial conflict management services establishment in the MENA region.
  3. Can Taswiyeh suggest any solution to one of the parties or both ?
  4. Yes, Taswiyeh does suggest solutions to both parties but remains neutral to maintain the integrity of the dispute resolution process.

  5. Can the parties authorize their lawyers to represent them at taswiyeh ?
  6. There is no problem with that, but it would be more advisable if the parties communicate directly with us in order to identify their opinions on the proposed solutions easily.

  7. Is there a particular time to choose Taswiyeh Services?
  8. No, you can enter Taswiyeh at any time during the dispute process. Even if there is a case which is registered and being solved using litigation or was already solved but it is in the implementation phase, you can come to us. We have been handling cases all over the GCC countries, many of which have not been solved with lawyers.

  9. Does dealing with Taswiyeh represent any sort of a weakness?
  10. No, there are no such risks when engaging in Taswiyeh. We encourage communication at all times; there is no stigma of vulnerability through negotiation. Even if your position is more powerful than the other party, you can still go for amicable settlement.

  11. Do mediators from taswiyeh have the required knowledge of international rules and regulations?
  12. The firm encompasses a variety of well-trained managerial, financial and legal advisors. We are involved in international and local agreements as well as exchange of experience programs.
  13. What do I, as a party in a dispute, have to do ?
  14. Nothing; the entire process of Taswiyeh is voluntary, and you can provide us with an authorization to do whatever seems to be right for both parties without any obligations.

  15. Who pays the fees for Taswiyeh? And do I have to pay even if the taswiyeh process was not successful?
  16. It depends from one case to another and according to the agreement with the firm. Sometimes both parties have to pay the Taswiyeh fee equally or as per the original contract agreement made with the firm. Taswiyeh charges the party only upon success.

  17. Who imposes the final settlement on the parties of the disputes?
  18. Taswiyeh suggests the best solution to end the disputes between the parties without imposing suggestions on any of the parties; the firm mediates between the parties to reach a mutual settlement, but leaves the final decision to the parties whether they want to agree on it, or to use other alternative dispute resolution in case they did not agree on the proposed solutions.

  19. Can I leave Taswiyeh even after signing the contract agreement?
  20. Yes, you may leave Taswiyeh at any time and at any stage of the process. All the documents, discussions and information related to the concerned person will remain confidential. Even the information collected from any of the disputed parties or from external sources will remain confidential.

  21. Does Taswiyeh conducts any meetings with the parties of the disputes before signing the Taswiyeh agreement?
  22. No, our policy does not permit any meetings with the parties in dispute or propose any suggestions or solution before signing the contract agreement and the confidentiality agreement.
